Client Agreement & Project Terms
This document explains what is included in the Sonic Brand Identity™ project, how the project works, what the client can expect, and what happens after the project begins.
The goal is simple:
You should know exactly what you're investing in before you approve the project.

The Sonic Brand Identity™ is a custom sound identity created for your brand.
Instead of using a different piece of music or sound every time your company communicates, 4th Vision develops a recognizable sonic system that can be used across your marketing, communications, content, and other agreed brand applications.
The final identity is built around your company's:
- Brand personality
- Audience
- Positioning
- Emotional goals
- Communication style
- Intended applications
- Creative direction
The final scope is defined in your individual Statement of Work (SOW) before production begins.
02 Standard $12,000 Package
Sonic Logo
A primary sonic logo, typically 3–5 seconds, created around the approved creative direction and intended brand applications.
Brand Theme
A custom 60–90 second signature composition representing the brand's larger sonic identity.

03 Your Creative Process
Every Sonic Brand Identity™ follows a simple seven-phase process:
01 — Discover
We learn about your brand, audience, goals and intended applications.
02 — Define
We establish the creative direction for the sound.
03 — Compose
4th Vision develops the sonic identity based on the approved direction.
04 — Review
You receive the work for review and feedback.
05 — Refine
We make the agreed revisions.
06 — Finalize
The approved work is prepared for final delivery.
07 — Deliver
You receive your completed Sonic Brand Identity™ package.
04 Creative Direction
The standard package includes one creative direction.
The creative direction is developed from the information gathered during the discovery and strategy process.
Our goal is not to give you several unrelated ideas and ask you to choose one.
Our goal is to understand your brand and develop one intentional sonic direction around it.
If you decide that you want to pursue a substantially different creative direction after the original direction has been established, that may be treated as new project scope and quoted separately.
05 Revisions
The standard package includes:
2 Revision Rounds
A revision round means client feedback that modifies the approved creative direction.
For example:
- adjusting instrumentation
- changing an arrangement
- refining a vocal
- modifying timing
- adjusting a musical element
- making agreed creative refinements
A revision is not the creation of an entirely different creative direction.
Additional revision rounds are available at:
$550 per additional revision round
Additional work will be discussed and approved before it begins.
06 Client Approval
Creative approval is an important part of the process.
Before 4th Vision moves into final production, the client approves the creative direction in writing.
Approval may be provided by email, electronic signature, or another agreed written method.
This gives both sides a clear point of reference for the project.
Once a creative direction has been approved, requests for a substantially different direction may require a new scope and additional fee.
07 Project Timeline
The standard estimated production timeline is:
3–6 weeks
The timeline begins after:
- The required payment has cleared; and
- 4th Vision has received the required client materials, information and brief.
The timeline is an estimated production window, not a guarantee of a specific completion date.
Client delays can affect the timeline.
If 4th Vision is waiting for required materials, feedback or approval, the project timeline may pause until those items are received.
If a client delay extends significantly, the project may be rescheduled based on current production availability.
08 Payment
The standard Sonic Brand Identity™ investment is:
$12,000
Payment is divided into two installments:
- 50% — Project Start
- 50% — Before Final Delivery & Ownership Transfer
Production begins after the required initial payment has cleared and the required project materials have been received.
09 Final Payment
The remaining balance must be paid before final ownership and final project files are released.
If payment is not received:
- Production may pause.
- Final files may be withheld.
- Ownership of the final deliverables does not transfer.
Once the full project balance has been paid, the agreed ownership rights for the final deliverables transfer according to the applicable project agreement.
10 Cancellation
The initial project payment reserves production time and begins the project.
Once production has begun, the initial payment is non-refundable.
If the client cancels before substantive project production begins, the parties may determine the appropriate treatment of the payment based on the work already performed and the circumstances of the cancellation.
If the project is terminated after production begins, 4th Vision may retain amounts already paid and may charge for additional approved work already completed.
Any termination will be handled in writing.
11 Changes to the Project
The $12,000 investment covers the scope defined in the agreed SOW.
If the client requests work outside that scope, 4th Vision will provide a separate written quote or add-on.
Examples may include:
- Additional sonic identities
- Additional versions
- Additional creative directions
- Additional production assets
- Additional applications
- Additional revision rounds
- Expanded sound systems
- New deliverables not included in the SOW
Additional work will not begin without written approval.
This protects both the client and 4th Vision from surprise charges.
12 Ownership
Once the project has been paid in full, the client receives the agreed ownership rights to the final approved Sonic Brand Identity™ deliverables identified in the SOW.
4th Vision retains ownership of its:
- Pre-existing materials
- Production methods
- General know-how
- Workflows
- Templates
- Internal tools
- Techniques
- Unused concepts
- Rejected concepts
- Unselected creative directions
Third-party materials remain subject to their applicable licenses and restrictions.
The exact legal ownership and transfer language will be defined in the final project agreement.
13 Third-Party Creative Professionals
Depending on the project, 4th Vision may work with qualified creative professionals such as:
- Musicians
- Vocalists
- Voice actors
- Engineers
- Producers
- Contractors
- Other specialized production professionals
4th Vision manages these production relationships as necessary to complete the agreed project.
14 Original & Licensed Materials
4th Vision creates original project-specific material for the client.
When appropriate, the project may also include properly licensed third-party materials such as:
- Sound effects
- Samples
- Production elements
- Subscription-library materials
Any third-party material remains subject to the applicable license terms.
4th Vision does not promise ownership of third-party materials that cannot legally be transferred.
15 Artificial Intelligence
4th Vision does not use generative AI to create the client's Sonic Brand Identity™.
4th Vision does not use AI-generated recordings as part of the standard Sonic Brand Identity™ production process.
If the production method ever materially changes, the client will be informed and any required approval will be obtained.
16 Client Materials
The client is responsible for making sure that any materials supplied to 4th Vision may legally be used for the project.
This may include:
- Logos
- Brand assets
- Music
- Recordings
- Scripts
- Voice recordings
- Images
- Reference materials
- Other copyrighted materials
The client represents that it has the necessary rights or permissions for materials it provides.
17 Delivery
Final project files are delivered digitally.
Standard delivery formats include:
- WAV
- MP3
- Full stems where included in the SOW
The standard download period is:
90 Days
After the standard download period, file retrieval or redelivery may be available for:
$75
18 Technical Warranty
4th Vision will correct genuine technical defects in the final deliverables caused by 4th Vision for 90 days following delivery.
This warranty does not include:
- New creative requests
- Additional features
- New versions
- New concepts
- Changes to previously approved creative decisions
- Requests outside the original SOW
- Changes caused by third-party systems or equipment
In simple terms:
If something we delivered is technically wrong, we will address it.
If you want something new or different, that may be additional work.
19 No Guarantee of Business Results
The Sonic Brand Identity™ is a creative and strategic service.
4th Vision does not guarantee specific business results such as:
- Increased revenue
- Increased sales
- Increased conversions
- Increased customer recognition
- Market share
- Viral performance
- Awards
- Specific return on investment
Our responsibility is to create and deliver the agreed creative work professionally and according to the agreed scope.
20 Confidentiality
Both parties agree to treat confidential business, financial, creative and project information received from the other party as confidential, except where disclosure is required by law or the information is already publicly available.
Confidentiality obligations continue after the project ends.
Additional confidentiality or NDA requirements can be added for projects that require them.
21 Portfolio & Professional Use
4th Vision Studios may display completed work in its:
- Portfolio
- Website
- Social media
- Presentations
- Marketing materials
- Industry showcases
- Award submissions
4th Vision may also identify the client by name when presenting completed work.
If a project contains confidential or unreleased information, the parties may agree in writing to delay public presentation until an agreed date.
22 Communication
Normal project communication may take place through:
- Text/SMS
- Other mutually agreed communication methods
For important project decisions, including:
- Creative approval
- Scope changes
- Additional work
- Payment changes
- Cancellation
- Formal notices
written confirmation should be provided by email or another agreed written method.
23 Client Response Time
To keep the project moving, clients should respond to project deliveries within:
5 Business Days
If no response is received within that period, the applicable deliverable may be treated as accepted as-is, and the project timeline may continue.
If additional time is needed, simply communicate that to 4th Vision.
24 Disputes
If a disagreement occurs, both parties agree to first attempt to resolve the issue through good-faith communication.
If the issue cannot be resolved directly, the parties will attempt mediation before pursuing other available legal remedies, subject to the final agreement and applicable Florida law.
25 Governing Law
The project is governed by the laws of the:
State of Florida
The final agreement will identify the appropriate Florida county and dispute forum.
26 Electronic Agreement
The parties may use electronic records and electronic signatures to approve the project and related documents.
Electronic approvals may have the same effect as written approvals where permitted by applicable law.
27. The Simple Version
Agreement
By approving the accompanying Statement of Work and making the required initial payment, the Client acknowledges that they have reviewed the project scope, investment, process, responsibilities and expectations described above.
The final Master Creative Services Agreement and Statement of Work will govern the completed transaction.

Client Agreement & Project Terms
This agreement outlines the Caller Experience™ service, project scope, payment terms, responsibilities, delivery expectations, and related project terms.
Clear expectations. Professional production. A better caller experience.
These Project Terms are intended to be read together with the project-specific Statement of Work (SOW), proposal, invoice, or written project confirmation. The applicable project documents define the exact services, deliverables, and requirements for your project.
This is a business contract draft and is not a substitute for advice from a licensed attorney. The final agreement should be reviewed by legal counsel before use.
At a Glance
01 Purpose & Service
Caller Experience™ is a custom audio production service designed to create a consistent, professional audio experience across the Client’s customer phone journey.
4th Vision Studios LLC (“4th Vision”) will design, produce, and deliver the agreed audio components for the Client’s phone or customer-communication system according to the scope established during discovery and documented in the SOW or other written project confirmation.
The objective is to make the Client’s phone experience sound intentional, professional, recognizable, and consistent with its brand.
This is a creative production service. 4th Vision does not guarantee specific business or financial outcomes.
02 Standard Investment & Project Limits
The standard Caller Experience™ project investment is $5,000 USD.
This investment covers one defined Caller Experience™ project and the scope documented in the approved SOW or written project confirmation.
The service is not an unlimited-audio, unlimited-version, or unlimited-revision arrangement.
Additional work outside the approved scope may require a separate written quote, change order, or add-on agreement.
4th Vision will not begin out-of-scope work until the Client has approved the applicable scope and fees in writing.
03 Project Scope & Included Services
Depending on the Client’s needs and the approved SOW, the project may include components such as:
- Main company greeting
- IVR voiceover and automated prompts
- Menu and department prompts
- Hold/on-hold messaging and hold music
- Call queue messaging
- Voicemail greeting
- After-hours and holiday messaging
- Background music and original music
- Sound design and sound effects
- Other agreed phone-system audio
The exact components, quantities, scripts, voice talent, musical direction, and production requirements will be documented in the SOW or written project confirmation.
The standard package does not mean unlimited versions, departments, scripts, languages, or audio assets.
04 Creative Direction
4th Vision will develop the creative direction based on the Client’s brand, goals, audience, phone experience, and approved project scope.
The project includes one primary creative direction unless the SOW states otherwise.
Original music created by 4th Vision may be used when appropriate. The Client may provide existing music, scripts, brand materials, or other approved assets when applicable.
A request for a substantially different creative direction, musical direction, messaging strategy, or project concept may be treated as a new scope of work rather than a revision.
05 Voice Talent & Third-Party Costs
Professional voice talent may be included when appropriate to the agreed project scope. 4th Vision may recommend and coordinate professional voice talent.
If the Client requests a specific voice actor, celebrity voice, language, accent, specialized performer, or other talent requiring additional fees, those costs may be quoted separately.
Third-party music, samples, sound effects, licensing, subscription-library materials, or other external production costs may also be additional.
4th Vision will communicate material third-party costs before committing the Client to those expenses when reasonably possible. Any additional costs require Client approval before commitment.
06 Scripts, Messaging & Client-Specific Accuracy
Scripts may be:
- Supplied by the Client
- Developed or refined by 4th Vision
- Created collaboratively
The final scripting responsibility and scope will be documented in the SOW.
4th Vision may recommend changes to improve clarity, pacing, tone, or the overall caller experience.
The Client is responsible for the final factual accuracy of company information, phone numbers, department names, policies, hours, legal statements, pronunciations, and other Client-specific information.
Client approval is required before final production of materials containing Client-specific information. The Client is responsible for supplying or approving required legal or compliance language.
07 Revisions
The standard Caller Experience™ project includes:
Two (2) Revision Rounds
A revision round means reasonable feedback intended to modify the approved creative direction or production.
Examples may include:
- Adjusting voice delivery
- Changing timing
- Making minor music adjustments
- Editing wording
- Adjusting sound design
- Correcting production details
Additional revisions beyond the included two rounds are billed at:
$450 per additional revision round
A substantially new creative direction, major script rewrite, additional departments, new deliverables, or material expansion of the original scope may be treated as new scope rather than a revision.
Additional revision or out-of-scope work will be discussed and approved in writing before it begins.
08 Production, Files & Delivery
4th Vision will produce the agreed audio assets and deliver them as individual, clearly labeled files where appropriate.
Typical delivery formats include:
- WAV
- MP3
Other formats may be considered when technically necessary and agreed upon.
Illustrative file names may include:
- Company Greeting.wav
- Main Menu.wav
- Sales Department.wav
- Support Department.wav
- Billing Department.wav
- Hold Message.wav
- Hold Music.wav
- Voicemail.wav
- After Hours.wav
The exact file list and quantities depend on the approved SOW. Full stems or other production assets are included only when identified in the SOW.
Final project files are delivered digitally.
09 Phone System Implementation
4th Vision produces and delivers the agreed creative and audio assets.
The Client, its telecommunications provider, phone-system provider, IT team, or other designated party is responsible for uploading, configuring, implementing, and maintaining the audio within the Client’s phone system.
4th Vision may provide reasonable guidance regarding delivered files but is not responsible for third-party phone-system configuration unless separately agreed in writing.
The Client is responsible for providing applicable technical specifications.
4th Vision does not guarantee compatibility with a specific phone-system provider unless compatibility has been specifically confirmed in writing before production.
10 Project Timeline
The expected project timeline is approximately:
2–4 Weeks
The timeline begins after:
- The required payment has cleared;
- The project scope has been approved; and
- Required Client materials, scripts, brand information, technical requirements, and other necessary information have been received.
The timeline is an estimate and may be affected by Client delays, missing materials, feedback, or approvals.
If required information or approvals remain outstanding for an extended period, 4th Vision may pause or reschedule production based on availability.
11 Payment
The total standard project investment is:
$5,000 USD
Payment terms, installment amounts, and due dates will be stated in the project invoice or SOW.
Production will not begin until the required initial payment has cleared and the project prerequisites described in the SOW have been satisfied.
Unless otherwise agreed in writing, payments become non-refundable once substantive production begins, subject to applicable law.
Final delivery and transfer of the applicable ownership rights are subject to full payment of all amounts due.
12 Cancellation & Termination
The Client may request cancellation before substantive production begins.
If cancellation occurs before substantive production begins, any refund or retained amount will be determined according to the applicable payment terms, work already performed, committed costs, and project circumstances, subject to applicable law.
If the Client cancels or the project is terminated after substantive production begins, 4th Vision may retain amounts already paid to cover work performed, production time, committed third-party costs, and project resources, and may charge for additional approved work already completed.
Any cancellation or termination should be communicated in writing.
13 Ownership & Rights
After the Client has paid all amounts due under the project, the Client owns the final custom audio deliverables specifically created and delivered for the Client under the approved project scope, subject to the limitations in this section and any applicable third-party license.
4th Vision retains ownership of its:
- Pre-existing materials
- General production methods
- Workflows and templates
- Production techniques
- Internal systems
- General know-how
- Unused or rejected concepts
- Materials not specifically created for the Client
- Other underlying tools or materials
Third-party music, samples, voice talent, sound effects, and other licensed materials remain subject to their applicable license terms.
4th Vision does not promise ownership or transfer rights in third-party materials beyond what the applicable license permits.
14 Portfolio Use
Unless the Client requests confidentiality in writing, 4th Vision may display completed project work for:
- Portfolio
- Website
- Social media
- Promotional purposes
- Educational purposes
- Demonstrations and presentations
- Marketing purposes
4th Vision will not intentionally disclose confidential business information that is not necessary to demonstrate the completed work.
If a project is confidential or unreleased, the Client may request in writing that portfolio use be delayed or excluded.
15 Client Responsibilities & Materials
The Client agrees to provide accurate information and materials reasonably necessary to complete the project, including, as applicable:
- Brand information
- Existing phone scripts
- Phone-system requirements
- Existing audio
- Business and department information
- Correct names and pronunciations
- Required legal or compliance language
- Timely feedback and approvals
The Client represents that it has the necessary rights or permissions to provide any materials, recordings, music, trademarks, scripts, images, or other intellectual property supplied to 4th Vision for use in the project.
The Client is responsible for claims arising from unauthorized materials it supplies.
Delays caused by missing information, materials, approvals, or communication may affect the project timeline.
16 Scope Changes & Future Work
Any request that materially changes the approved project scope must be agreed upon in writing and may require a change order, separate quote, or add-on agreement.
Examples include:
- Additional departments
- Additional languages
- Additional campaigns or scripts
- Additional creative directions
- Additional music or voice talent
- Additional audio systems
- Major script rewrites
- New deliverables or production services
No additional work will be required of 4th Vision until the applicable scope, fees, and any timeline adjustment have been approved in writing.
If the Client later wants refreshed music, updated messaging, new campaigns, new departments, new voiceover, or a substantially different creative direction, 4th Vision may provide a new project or additional scope.
Future work is not automatically included in the original $5,000 investment.
17 File Storage & Redelivery
Final project files will remain available for download for:
Ninety (90) Days Following Final Delivery
After that period, file recovery or redelivery may be subject to a $75 fee.
Clients are encouraged to download and maintain their own backup copies of all final files.
18 Technical Warranty
4th Vision provides a ninety (90) day technical warranty on final delivered files.
If a delivered file contains a production or technical error caused by 4th Vision, 4th Vision will correct the issue and re-deliver the affected file at no additional production charge.
This warranty does not cover:
- New creative requests
- Script changes
- New business information
- Changes to the Client’s phone system
- Third-party system or equipment issues
- Client-requested alterations after approval
- New versions or new creative directions
19 No Guarantee of Business Results
4th Vision provides creative and production services and makes no guarantee regarding:
- Increased sales or calls
- Customer retention
- Revenue
- Customer satisfaction
- Reduced call abandonment
- Marketing performance
- Conversion rates
- Any other specific business or financial result
Business outcomes depend on factors outside 4th Vision’s control.
20 Confidentiality
Each party agrees to use reasonable care to protect confidential information received from the other party and to use that information only for purposes related to the project.
Confidential information does not include information that:
- Is publicly available
- Was already lawfully known by the receiving party
- Is independently developed
- Is lawfully received from another source
- Must be disclosed by law
Confidentiality obligations continue after project completion to the extent applicable under law.
21 Limitation of Liability
To the extent permitted by applicable law, 4th Vision’s total liability arising from the project will not exceed the amount actually paid by the Client for the applicable project.
To the extent permitted by applicable law, neither party will be responsible for indirect, incidental, consequential, special, or lost-profit damages.
This provision should be reviewed and finalized by legal counsel.
22 Force Majeure
Neither party will be considered in breach or responsible for delay caused by circumstances reasonably beyond its control, including:
- Natural disasters
- Major technical failures
- Governmental actions
- Emergencies
- Internet or telecommunications failures
- Illness
- Other extraordinary circumstances
The affected party will communicate the delay and resume performance when reasonably possible.
23 Communication & Approval
Email is the primary method for formal project communication and approval. Text messaging may be used for secondary communication.
Creative approvals, scope changes, additional work, payment changes, cancellation, and other material project decisions should be confirmed in writing through email, electronic signature, written confirmation, or another documented method agreed by both parties.
24 Governing Law & Dispute Resolution
This agreement will be governed by the laws of the State of Florida, unless otherwise agreed in a final written agreement.
If a dispute arises, the parties agree to first attempt to resolve it through good-faith communication.
If the dispute cannot be resolved directly, the parties may attempt mediation before pursuing further legal remedies, where appropriate and subject to the final agreement and applicable law.
Any county-specific venue or dispute forum may be identified in the final agreement.
25 Electronic Agreement
The parties agree that electronic signatures, electronic approvals, and electronic records may be used to execute and administer this agreement and related project documents, subject to applicable law.
26 Statement of Work & Order of Precedence
The project-specific SOW, proposal, invoice, or written project confirmation may identify the phone-system structure, number and type of audio assets, scripts, voice talent, music direction, sound design, technical specifications, delivery requirements, timeline, approved scope, pricing, and approved additional services.
If these general Project Terms conflict with a project-specific SOW, the SOW will control only with respect to the specific project scope, deliverables, pricing, or requirements it expressly addresses.
Any broader modification should be stated in writing and approved by both parties.
27. The Simple Version
Client Acknowledgment & Agreement
By signing below and approving the applicable SOW or written project confirmation, the Client acknowledges that they have reviewed and understand these Project Terms.
The Client acknowledges that Caller Experience™ is a defined creative production service; the $5,000 standard investment covers the agreed scope and is not an unlimited-audio or unlimited-revision arrangement; two revision rounds are included; additional scope may require additional fees; final ownership is subject to full payment and the limitations above; phone-system implementation is the Client’s responsibility unless separately agreed; and 4th Vision does not guarantee specific business results.
The undersigned acknowledge that they have reviewed and agree to these Project Terms together with the applicable SOW or written project confirmation.
